Terms of Service

These terms set out how you may use Nook on this website and what you can expect from the operator who runs it. They are written to be read, so they are short and plain.

Project template — to be reviewed before publication

This document describes how the Nook software works. Whoever runs this installation (the operator) must review it, complete it and adapt it to their jurisdiction before relying on it. It is not legal advice.

Still to complete in this document:

  • Operator’s legal name — set NOOK_OPERATOR_NAME on the server
  • Operator’s postal address — set NOOK_OPERATOR_ADDRESS on the server
  • Contact email — set NOOK_CONTACT_EMAIL on the server
  • Security contact email — set NOOK_SECURITY_EMAIL on the server
  • Governing law and jurisdiction — set NOOK_GOVERNING_LAW on the server
  • 2 operator decisions marked in the text

About these Terms

These Terms of Service (the “Terms”) govern your use of Nook on this website (the “Service”). The Service is provided by [Operator legal name — complete before publication], [Operator postal address — complete before publication] (the “operator”, “we” or “us”).

Nook is software that a person or organization can run for themselves and others. The operator is whoever runs this particular installation: they configure it, decide how it is hosted and are responsible for it. These Terms are an agreement between you and the operator.

By creating an account, joining a call or otherwise using the Service, you agree to these Terms. They work together with the Privacy Policy, the Cookie Policy and the Acceptable Use Policy.

Words we use

These words have the same meaning in all four legal documents:

  • Account — your sign-in to the Service with an email address and password.
  • Meeting — a scheduled meeting or open room created in the Service, with its title, schedule, settings and members.
  • Call — the live part of a meeting, where participants talk, share video or their screen, chat and react.
  • Host — the organizer of a meeting and any co-hosts they appoint.
  • Guest — someone who joins a call through an invite link without signing in.
  • Content — what you put into the Service: meeting titles and descriptions, chat messages, reactions, contact notes and messages you send to the bot.
  • Simulated participant — a fictional participant that Nook generates in a simulation meeting.

Who can use the Service

You must be at least [minimum age — complete before publication] to create an account or use the Service.

If you use the Service on behalf of an organization, you confirm that you are allowed to accept these Terms for it.

Your account

You sign up with an email address, a display name and a password. Choose a password you don’t use anywhere else and keep it to yourself.

You are responsible for what happens in your account. You can see every device that is signed in, and sign any of them out, in Settings → Security. If you think someone else has access to your account, change your password, sign out the other sessions and tell us at [Security email — complete before publication].

You can change your display name and settings, download your data or delete your account at any time in Settings → Privacy & data.

Joining as a guest

You can join a call through an invite link without an account. You choose the display name others will see, and the Service recognizes you for the duration of your visit with a temporary guest cookie.

Hosts decide who gets in. A host may keep you in the waiting room, decline your request to join or remove you from a call. These Terms and the Acceptable Use Policy apply to guests as well.

Hosting meetings

When you create a meeting, you become its organizer and can appoint co-hosts. Hosts get extra controls, and with them extra responsibilities:

  • Invites. Share invite links only with the people you mean to invite. Depending on the meeting’s access settings, anyone holding a valid link may be able to join. If a link reaches the wrong people, create a new one — old links stop working immediately.
  • Waiting room. Turn on the waiting room when you want to check who is joining before you let them in.
  • Moderation. Hosts can mute participants, lower raised hands, lock the room, turn chat off and remove people. Use these controls fairly and in line with the Acceptable Use Policy.
  • Ending. Hosts can end a call for everyone at any time. Ended and cancelled meetings can’t be joined.

Hosts are responsible for how their meetings are used, including whom they invite and what is shared in them.

Your content

You keep ownership of your Content.

You give the operator permission to store, copy, process and display your Content only as far as needed to run the Service for you and the people you share it with — for example, to show your chat messages to other participants, deliver invitations and reminders, and keep the meeting’s history. This permission ends when your Content is deleted, except as described in the Privacy Policy.

Chat messages, reactions and raised hands are saved with the meeting’s history. Other participants see them during the call, and the meeting’s history keeps them afterwards.

You are responsible for your Content and must have the right to share it.

No recording

Nook does not record calls. It has no feature for recording audio, video, screen sharing or chat as a media file.

Don’t record a call, take screenshots of other participants or capture what they share unless everyone who is captured has agreed and the law allows it.

Audio, video and screen sharing are sent in real time through a media server and are encrypted in transit, but Nook does not provide end-to-end encryption. The Privacy Policy explains how media is handled.

The messaging service bot

An approved connected service can create and manage meetings. Access is controlled by the service administrator.

messaging service is a separate service run by a third party. Your use of messaging service is governed by messaging service’s Terms of Service (opens in a new tab) and Privacy Policy (opens in a new tab), and messages between you and the bot travel through messaging service’s servers. The operator is not responsible for messaging service.

Some installations offer a built-in bot console instead. It runs the same bot inside Nook, without messaging service.

Preview mode and simulated participants

The operator may run the Service in preview mode to show how Nook works. In preview mode you can sign in with a shared sample account. Anyone can use that account, so don’t put personal or confidential information into it. Its data may be reset at any time without notice.

Simulation meetings can contain simulated participants. They are fictional: Nook generates their names and avatars, and their behavior is scripted. They are not real people, and the Service always labels them “Simulated”. Real people can join simulation meetings too.

You must not present simulated participants as real people or use simulation meetings to mislead anyone.

Acceptable use

You must follow the Acceptable Use Policy. In short: use the Service lawfully, treat other people with respect, don’t record anyone without consent, don’t pass off simulated participants as real people, and don’t attack, overload or work around the Service’s protections.

Availability and changes to the Service

The Service is provided “as is” and “as available”. The operator does not promise any particular uptime or that the Service will always be available. Calls also depend on things outside the operator’s control, such as your network, device and browser and, where used, third-party services like the media server provider and messaging service.

Audio and video work only when the operator has connected a media server. Without one, meetings, chat and the rest of the Service still work, but no audio or video is transmitted.

The operator may change, add or remove features and may pause the Service for maintenance.

Suspension and termination

You can stop using the Service at any time and delete your account in Settings → Privacy & data. Deleting your account signs out all your sessions, removes your messaging service link, deletes the meetings you organized together with their call history and chat (members of upcoming ones are notified), and deletes your contacts, notifications and settings. In meetings organized by other people, your name in call records and chat messages is replaced with “Deleted user”.

The operator may suspend or close your account, or remove you from the Service, if you seriously or repeatedly break these Terms or the Acceptable Use Policy, if the law requires it, or to protect other people or the Service.

Disclaimers

To the extent the law allows, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. The operator does not promise that the Service will be uninterrupted, free of errors or that Content will be preserved.

Nothing in these Terms takes away rights you have under laws that cannot be changed by agreement, such as mandatory consumer protection laws where you live.

Limitation of liability

To the extent the law allows, the operator is not liable for indirect, incidental, special or consequential damages, or for lost data, profits or goodwill, arising from your use of the Service.

To the extent the law allows, the operator’s total liability for all claims relating to the Service is limited to [liability limit — complete before publication].

These limits don’t apply to liability that the applicable law does not allow to be limited or excluded.

Changes to these Terms

The operator may update these Terms. The date at the top shows when they last changed. If a change significantly affects you, the operator will announce it in the Service before it takes effect.

If you keep using the Service after a change takes effect, the updated Terms apply. If you don’t agree with them, stop using the Service and delete your account.

General

If a court finds part of these Terms unenforceable, the rest stays in effect. If the operator doesn’t enforce a part of these Terms straight away, that is not a waiver of it. You may not transfer your rights under these Terms to someone else without the operator’s agreement.

Governing law

Governing law and place of jurisdiction: [Governing law and courts — complete before publication].

This choice doesn’t take away the protection of mandatory laws of the country where you live.
